In July 2012, Indiana passed its “Second Chance Act” or “Second Chance Law”, which was designed to give past offenders an opportunity for a fresh start and to put their past
offenders, such as sexual or violent offenders, and it often limited to defendants who completed their sentences and court ordered obligations successfully. The new Indiana law has two (2) essential parts:

  • Felony Reduction. If at least three (3) years have passed since a defendant completed all of his or her court ordered obligations, he or she may qualify to have a D Felony reduced and entered as an A Misdemeanor. This can restore the convicted person’s right to vote, possess and/or carry a firearm, or allow the person to hold public office.
  • Criminal Record Sealing. If at least eight (8) years have passed since the completion of the convicted person’s court ordered obligations, he or she may be eligible to have his or her criminal record sealed. This differs from the traditional notion of “expungement”, but it does provide a second chance to those with a criminal past. It prevents potential employers from finding past criminal mistakes, and allows the person the opportunity to obtain gainful employment.
